How a case moves here
Dallas County follows Iowa law on arrests, release, and courts. These rules are the same in every county in the state; the full set covers prosecutors, defense, and jails too.
- Who decides release first
When court is not in session, jail or police staff may release a person under the judicial council's statewide bond schedule before the person sees a magistrate. A judge or magistrate may also order release by phone. Otherwise a magistrate sets release at the initial appearance and must put the order in writing.

After a warrantless arrest, police must take the person before the nearest or most accessible magistrate without unnecessary delay. Iowa law sets no number of hours.

Iowa courts may set money bail as a condition of release, along with release on recognizance, unsecured bonds, and other conditions.

Iowa has one unified trial court, the district court, which hears every criminal case. Inside it, district judges try felonies, district associate judges hear many misdemeanors, and magistrates hear simple misdemeanors and hold initial appearances.

The governor appoints district judges and district associate judges from lawyers nominated by a district nominating commission. Judges then stand in retention elections, and district judges serve six-year terms after that. A county commission appoints magistrates, who must be lawyers except for a few non-lawyers already serving in 2009.
