How a case moves here
Washington County follows Maryland law on arrests, release, and courts. These rules are the same in every county in the state; the full set covers prosecutors, defense, and jails too.
- Who decides release first
A District Court commissioner, a court officer who is not a judge, decides release at the initial appearance, usually around the clock at central booking. Commissioners can't release people charged with listed serious offenses, such as a crime of violence with a prior conviction for one, or violating a protective order; a judge decides those.
Md. Code, Crim. Proc. 5-202Md. Rule 4-216- Time to see a judge
A person arrested without a warrant must be taken before a District Court judicial officer without unnecessary delay and no later than 24 hours after arrest. A person still held 24 hours after a commissioner sets conditions goes before a judge at the next court session.
Md. Rule 4-212(f)(1) and 4-216(f), as compiled in Maryland Judiciary, Maryland Laws on Pretrial Release- Money bail
Money bail is allowed. Since July 1, 2017, court rules require judges and commissioners to consider what a person can pay and to prefer conditions without money.
Md. Rule 4-216.1; Maryland Judiciary news release on the 2017 pretrial release rules- Courts
The circuit court in each county and Baltimore City holds jury trials and hears the more serious criminal cases. The District Court, a single statewide court, hears misdemeanors and some felonies without a jury.

The governor appoints circuit court judges, who must then run in the next general election at least a year away, where other lawyers may run against them, for a 15-year term. District Court judges are appointed by the governor with Senate consent for 10-year terms and must be members of the Maryland bar.

Read from the statutes and court rules cited, 2026-09-30. Some of this is medium confidence and still being checked. Rule 4-212(f) text comes from a Judiciary compilation of older date, not the current rule book. Commissioner qualifications were not found. Which counties use a county corrections department rather than the sheriff was not listed; Baltimore County's page refused our fetch.
